Gym Waiver and Release of Liability / Exención y Liberación de

I. Acknowledgment of Risks
I, the undersigned Member, acknowledge that
participation in physical activities, use of gym equipment,
and exercise programs at Hourglass Fitness & Wellness
LLC (the “Gym”) involves inherent risks, including but not
limited to injuries, falls, accidents, or health complications.
I understand that participation is voluntary and that I am
solely responsible for my health and safety while using the
facility.

Yo, El Miembro que firma a continuación, reconozco que
la participación en actividades físicas, el uso de equipos
del gimnasio y los programas de ejercicio en Hourglass
Fitness & Wellness LLC (el “Gimnasio”) implica riesgos

II. Assumption of Responsibility
I voluntarily assume all risks associated with the use of the
Gym, its equipment, and participation in any activity or
program. I accept full responsibility for any injuries, losses,
or damages that may result from my actions or
negligence.

el uso del Gimnasio, su equipo y la participación en
cualquier actividad o programa. Acepto toda la
responsabilidad por cualquier lesión, pérdida o daño que
pueda resultar de mis acciones o negligencia.

III. Release and Waiver of Liability
I hereby release and discharge Hourglass Fitness &
Wellness LLC, its owners, employees, trainers, agents,
and representatives from any and all claims, demands,
causes of action, or liability arising out of or connected
with any injury, loss, or damage sustained while on Gym
premises or participating in Gym activities, whether
caused by negligence or otherwise.

Hourglass Fitness & Wellness LLC, sus propietarios,
empleados, entrenadores, agentes y representantes de
cualquier reclamo, demanda, causa de acción o
responsabilidad que surja o esté relacionada con
cualquier lesión, pérdida o daño sufrido mientras me
encuentre en las instalaciones del Gimnasio o participe en
actividades del Gimnasio, ya sea causado por negligencia
u otra razón.

IV. Medical Clearance
I affirm that I am in good physical condition and capable of
engaging in exercise activities. I acknowledge that it is my
responsibility to consult a physician prior to beginning any
fitness program. I agree to immediately inform Gym staff
of any injury, illness, or change in my medical condition.

Afirmo que estoy en buena condición física y soy capaz
de participar en actividades de ejercicio. Reconozco que
es mi responsabilidad consultar a un médico antes de
comenzar cualquier programa de ejercicios. Acepto
informar de inmediato al personal del Gimnasio sobre
cualquier lesión, enfermedad o cambio en mi condición
médica.

V. Use of Facilities and Equipment
I agree to use all Gym facilities and equipment properly
and respectfully. I will follow all posted rules and
instructions given by Gym staff. I understand that improper
use of equipment or disregard of safety guidelines may
result in suspension or termination of my membership.

Acepto usar todas las instalaciones y equipos del
Gimnasio de manera adecuada y respetuosa. Seguiré
todas las reglas publicadas y las instrucciones del

VI. Personal Belongings
I understand that Hourglass Fitness & Wellness LLC is not
responsible for lost, stolen, or damaged personal property.
I agree to take reasonable precautions to secure my
belongings while on the premises.

responsable por la pérdida, robo o daño de pertenencias
personales. Acepto tomar precauciones razonables para
asegurar mis pertenencias mientras esté en las
instalaciones.

VII. Photography and Media
I consent to the use of my likeness, photos, or videos
taken in the Gym for promotional purposes by Hourglass
Fitness & Wellness LLC. I understand that no
compensation will be provided for such use.

videos tomados en el Gimnasio con fines promocionales
por parte de Hourglass Fitness & Wellness LLC. Entiendo
que no se proporcionará compensación por dicho uso.

VIII. Acknowledgment and Agreement
I have read and fully understand this Waiver and Release
of Liability. I voluntarily agree to its terms and understand
that by signing below, I am waiving certain legal rights,
including the right to sue Hourglass Fitness & Wellness
LLC for negligence.

Fitness Center Membership Agreement

I. Agreement Overview

This Fitness Center Membership Agreement (Agreement) is entered into on
_____________member___________, between Hourglass Fitness & Wellness LLC, a fitness
center located at 23128 FM 1314 suite D, Porter TX 77365, hereinafter referred to as & "the
Fitness Center," and __________________________, a member hereinafter referred to
as & "the Member." This Agreement sets forth the terms and conditions under which the
Member will utilize the services and facilities of the Fitness Center.

II. Membership Terms and Conditions
1. Membership Duration
The Member agrees to a membership term starting on ________________________
and continuing a recurrent payment  basis, as agreed upon by
both parties. The membership will automatically renew each month unless terminated
by either party with a 30-day written notice prior to the renewal date.
2. Membership Termination
The Member may terminate their membership by providing written notice to Hourglass
Fitness & Wellness LLC at info@yourhourglassfitness.com The termination request
must be submitted at least 30 days prior to the intended termination date. Any dues or
fees accrued up to the termination date must be paid by the Member.

III. Membership Rights and Benefits
1. Access to Facilities
The Member shall have access to all fitness facilities offered by the Fitness Center,
including the gym, and other amenities, as available during
normal business hours. The Member’s access is subject to the rules and regulations of
the Fitness Center.
2. Additional Services

The Member may be eligible for additional services such as personal training,
specialized fitness programs, and events. These services may incur additional fees,
which will be communicated to the Member in advance.

IV. Membership Fees and Payment Schedule
1. Payment Terms
The Member agrees to pay the membership fee in the amount of $85 monthly or as per
the option selected during registration. The membership fee is non-refundable and must
be paid in advance. Additional charges for extra services may be applied on a case-by-
case basis.
2. Payment Schedule
The monthly membership fee is due on ___________________, or upon the start of the
membership term. Payments can be made via credit card, debit card, or other methods
agreed upon by the Fitness Center.

V. Member Responsibilities
1. Use of Facilities
The Member agrees to use the Fitness Center’s facilities and services in a responsible
manner, adhering to all posted rules and guidelines. The Member must refrain from
engaging in any activity that may cause harm to themselves, others, or the Fitness
Center property.
2. Health and Safety
The Member affirms that they are in good health and physically capable of participating
in fitness activities. The Fitness Center encourages members to consult with a physician
before beginning any exercise program. The Member is responsible for any injuries that
may occur while using the facilities. By signing this agreement, the participant
acknowledges and agrees that they are waiving any and all claims against Hourglass
Fitness & Wellness LLC for damage, injuries, or losses resulting from their participation
in physical activity, and that Hourglass Fitness & Wellness LLC is not liable for any such
damage, injuries, or losses.
VI. Liability and Insurance
1. Assumption of Risk

The Member acknowledges that physical activities, including the use of fitness
equipment, carry inherent risks. The Member voluntarily assumes all risks associated
with participation and agrees to hold the Fitness Center harmless for any injuries or
accidents.
2. Insurance
It is recommended that the Member maintain personal health insurance to cover any
injuries sustained during participation in Fitness Center activities. The Fitness Center
does not provide any insurance coverage for Members.

VII. Fitness center rules
1.Do not bring food into the fitness area
2.Do not drop dumbbells or other weights on the floor (please use weight mats)
3.Wipe off equipment and benches when finished, towel and cleaner will be supplied.
4. Members 13-17 years of age must be accompanied by a parent/guardian while on
premises.

IX. Membership Termination by Fitness Center
1. Grounds for Termination
The Fitness Center reserves the right to terminate this Agreement and the Member’s
membership for any of the following reasons:
Failure to pay membership fees on time.
Violation of the Fitness Center’s rules and regulations.
Conduct harmful to other members or the Fitness Center.

2. Notification of Termination
The Fitness Center will provide written notice to the Member if their membership is
terminated. Any outstanding fees must be paid by the Member at the time of
termination.

CANCELLATION AND REFUND NOTICE

1) “NOTICE TO PURCHASER: DO NOT SIGN THIS CONTRACT UNTIL YOU READ
IT OR IF IT CONTAINS BLANK SPACES.

(2) “IF YOU DECIDE YOU DO NOT WISH TO REMAIN A MEMBER OF THIS HEALTH
SPA, YOU MAY CANCEL THIS CONTRACT BY MAILING TO THE HEALTH SPA BY
MIDNIGHT OF THE THIRD BUSINESS DAY AFTER THE DAY YOU SIGN THIS
CONTRACT A NOTICE STATING YOUR DESIRE TO CANCEL THIS CONTRACT.
THE WRITTEN NOTICE MUST BE MAILED BY CERTIFIED MAIL TO THE
FOLLOWING ADDRESS:

(3) “IF THE HEALTH SPA GOES OUT OF BUSINESS AND DOES NOT PROVIDE
FACILITIES WITHIN 10 MILES OF THE FACILITY IN WHICH YOU ARE ENROLLED
OR IF THE HEALTH SPA MOVES MORE THAN 10 MILES FROM THE FACILITY IN
WHICH YOU ARE ENROLLED, YOU MAY:
(A) CANCEL THIS CONTRACT BY MAILING BY CERTIFIED MAIL A WRITTEN
NOTICE STATING YOUR DESIRE TO CANCEL THIS CONTRACT, ACCOMPANIED
BY PROOF OF PAYMENT ON THE CONTRACT TO THE HEALTH SPA AT THE
FOLLOWING ADDRESS:
23128 FM 1314, PORTER, TX, 77365 AND

(B) FILE A CLAIM FOR A REFUND OF YOUR UNUSED MEMBERSHIP FEES
AGAINST THE BOND OR OTHER SECURITY POSTED BY THE HEALTH SPA WITH
THE TEXAS SECRETARY OF STATE. TO MAKE A CLAIM AGAINST THE SECURITY
PROVIDE A COPY OF YOUR CONTRACT TOGETHER WITH PROOF OF
PAYMENTS MADE ON THE CONTRACT TO THE TEXAS SECRETARY OF STATE.
THE REQUIRED CLAIM INFORMATION MUST BE RECEIVED BY THE SECRETARY
OF STATE NOT LATER THAN THE 90TH DAY AFTER THE DATE NOTICE OF THE
CLOSURE OR RELOCATION IS FIRST POSTED ON THE SECRETARY OF STATE
INTERNET WEBSITE.

(4) IF YOU DIE OR BECOME TOTALLY AND PERMANENTLY DISABLED AFTER
THE DATE THIS CONTRACT TAKES EFFECT, YOU OR YOUR ESTATE MAY
CANCEL THIS CONTRACT AND RECEIVE A PARTIAL REFUND OF YOUR UNUSED
MEMBERSHIP FEE BY MAILING A NOTICE TO THE HEALTH SPA STATING YOUR
DESIRE TO CANCEL THIS CONTRACT. THE HEALTH SPA MAY REQUIRE PROOF

OF DISABILITY OR DEATH. THE WRITTEN NOTICE MUST BE MAILED BY
CERTIFIED MAIL TO THE FOLLOWING ADDRESS:

(b) A health spa operator is required to include the statement under Subsection
(a)(3)(B) in a contract only if the operator is required to post security with the secretary
of state under Subchapter D.
